After arguing vehemently on the merits of the case, learned counsel for the petitioner does not press the present petition and prays for withdrawal of the same,in light of the fact that his discharge application is pending before the Court of competent jurisdiction 2.

Accordingly, the present petition stands dismissed as withdrawn, with liberty to the petitioner to raise all the grounds and defences available to him before the trial Court including the one raised in the present petition and the trial Court shall proceed in accordance with law.

It is made clear that this Court has not expressed any opinion on the merits of the case.
