This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 263 dated 27.10.2014 under Section 376 IPC at Police Station Naraingarh district Ambala. Learned counsel for the State (on instructions from H.C. Ravinder Kumar, who is present in court) submits that pursuant to order dated November 21, 2014, petitioner has joined the investigation. According to him, custodial interrogation of the petitioner is required only for the purpose of recovering the car involved in the episode. However, I am of the considered view that petitioner has joined investigation and is cooperating with the investigating agency. Mobile phone used has already been recovered.

In view of the above, order dated November 21, 2014 whereby interim bail was granted needs to be made absolute. Ordered accordingly subject to the conditions as envisaged under Section 438(2) Cr.P.C.
