The present writ petition has been filed under Article 226 of the Constitution of India for issuance of an appropriate writ, order or direction, particularly in the nature of mandamus, directing the respondents to issue the No Objection Certificate (NOC) so as to enable release of retiral dues to the petitioner, who retired on 31.08.2025. It is averred that the said benefits have been withheld without any plausible or justifiable reason and in the absence of any charge-sheet or pending disciplinary/criminal proceedings against the petitioner. A further direction is sought for release of gratuity,

leave encashment, pension and all other admissible retiral benefits along with arrears, together with interest @12% per annum from the date the same became due till the date of actual payment. It is also prayed that appropriate directions be issued to the respondents to initiate departmental proceedings against the erring officials responsible for the alleged misutilization of project material by permitting its use for other projects. 2.

Learned counsel for the petitioner at this stage submits that he would be satisfied if a direction is issued to respondent No.1 to decide the legal notice dated 22.02.2026 (Annexure P-5) by passing a speaking order in a time bound manner.

Ms. Eknoor Kaur Sara, Advocate, waives service of notice on behalf of the respondents and filed Power of Attorney on behalf of the respondents, which is ordered to be taken on record. Registry is directed to place the same at an appropriate place. She submits that she has no objection in the event this Court issues a direction to respondent No.1 to consider and decide the legal notice dated 22.02.2026 (Annexure P-5) in a time-bound manner.

In view of the limited prayer made by counsel for the petitioner without commenting upon the merits of the case, the present petition is disposed of and respondent No.1 is directed to hear and decide the legal

notice dated 22.02.2026 (Annexure P-5) filed by the petitioner by passing a speaking order in a time-bound manner within a period of six weeks from the date of receipt of a certified copy of this order. 6.

Needless to say, if the petitioner is found entitled to the relief sought, the same be granted to him forthwith by respondents/competent authority.

Pending miscellaneous application(s), if any, shall also stands disposed of.
