(Oral) CRM-22030-2023 The instant application has been filed seeking recalling of order dated 2.5.2023 passed by this Court in CRM-M-39843-2017 on the ground that it was on account of inadvertence and on account of some miscommunication that an incorrect statement came to be made before this Court by learned counsel for the applicant/petitioner that the applicant/petitioner as well as respondent No.4 had expired. The application is duly supported by the affidavit of learned counsel for the applicant/petitioner.

CRM-M-39843-2017 (O&M) ( 2 ) In view of the reasons mentioned in the application, the same is allowed and order dated 2.5.2023 is recalled. The main case i.e. CRM-M39843-2017 is taken on board today itself. CRM-M-39843-2017 (Main Case) Learned counsel for the petitioner submits that as of now, the petitioner's daughter namely Ranjit Kaur as well as her husband i.e. respondent No.4 - Nirmal Singh are residing happily and he has no grievance of any kind and shall not initiate any such proceedings in future. He has thus submitted that he may be permitted to withdraw the main case itself.
