The petitioner seeks the concession of regular bail in a case registered at the instance of Amardeep Singh alleging that a sum of Rs. 1.25 lacs, collected by him from the customers, had been snatched by 3 boys on two motor cycles. Co-accused of the petitioner allegedly caused injuries on the head of Amardeep Singh. One of the accused persons allegedly threatened the complainant by aiming a pistol at him. Bag containing a sum of Rs. 1.25 lacs had been snatched from him. Counsel for the petitioner submits that the name of the petitioner has been disclosed by his co-accused during police custody. It is pertinent to observe here that out of 6 accused involved in the case, 3 have been acquitted and a set of 3 accused have been convicted.
Counsel for the petitioner submits that the case of the petitioner is at par with the accused, who were involved in the case on the basis of disclosure statement. It will be a debatable issue whether the petitioner was actually involved in the case or that on the basis of the statement of the co-accused, he could be held guilty. The petitioner has TAPINDER SINGH MANN 2015.02.
Cr.Misc. M 39908 of 2014 been in custody since 20.8.2014. Similar circumstanced co-accused have been acquitted by the trial court.
Taking into consideration the fact that the petitioner was declared a proclaimed offender and only one witness having been examined; custody of the petitioner being w.e.f. 20.8.2014, he can be granted the concession of bail without expression of any opinion on merits of the case.
The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court. The petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial.
