**** RAJ MOHAN SINGH, J.(Oral) CM-5208-CII-2023 This is an application under Section 151 CPC for withdrawal of the present appeal.

Learned counsel for the appellant submits that both the parties have decided to part ways and a sum of Rs.5.5 lakhs has been agreed to be given as permanent alimony to the respondent by the appellant.

Notice of motion in the main appeal was issued on 23.05.2022 on the premise that marriage of the appellant was MOHMED ATIK 2023.07.04 23.02 I attest to the authenticity and integrity of this order/judgment

FAO No.2179-2022 (O&M) 

  solemnized with the respondent on 04.09.2016 and there is no issue out of this marriage. The parties are living separately since 2017. As per record none has appeared on behalf of the respondent so far.

At this stage, learned counsel for the appellant wishes to withdraw the present appeal.

In view of above, the prayer made in the present application is allowed.
