Sonia Sharma and another .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr. BD Sharma,Advocate for the petitioners Jaswant Singh,J.(Oral) This common order shall dispose of aforesaid two petitions filed under Section 482 seeking quashing of the criminal complaint No.22/1/13 titled Sonia Sharma v Ranjan Sharma and others and summoning order dated 15.4.2014(P-2) whereby the petitioners have been summoned to face trial under Section 406,498-A,34 IPC. For the sake of convenience, order is being passed in CRMM 39957/2014 and a copy of the same will be placed on the file of CRM-M 37094/2014.
CRM-M 39957/2014 has been filed on behalf of the petitioners who are husband, father in law and mother in law of respondent complainant Sonia Sharma whereas CRM-M 37094/2014 has been filed on behalf of Jeth of the complainant-Sonia. The dispute being matrimonial in the nature, vide order RAJINDER PRASHAD JOSHI 2015.09.04 16:25 I attest to the accuracy and authenticity of this document High Court, Chandigarh.
CRM-M 39957/2014 and CRM-M 37094/2014 114+231 dated 25.11.2014 passed in CRM-M 39957/2014, was referred to Mediation Center of this Court to explore the possibility of an amicable settlement.
However, as per report dated 15.1.2015 of Mediator the mediation proceedings have failed.
At the time of hearing learned counsel for the petitioners prays for permission to withdraw the aforesaid two petitions in the light of development before the trial court wherein evidence of the complainant stands closed after awarding innumerable opportunities to her and still no evidence having been led by complainant. In view of the above, both these petitions stand dismissed as withdrawn at this stage.
A copy of this order be placed on the file of CRM-M 37094/2014.
