(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. is for quashing the impugned order dated 15.03.2017 (Annexure P-2) passed by the trial Court in Criminal Complaint No. 81 dated 15.09.2012, under Sections 420, 467, 468, 471, 120-B IPC, titled as "Sukhdev Singh Vs. Shamsher Singh and others", whereby the petitioner was declared as Proclaimed Offender.

Learned counsel for the petitioner inter alia contends that on the date of passing of the summoning order and, thereafter, the petitioner is still in United States of America (USA) and never visited India, therefore, he has wrongly been declared as Proclaimed Offender vide impugned order Annexure P-2. The petitioner shall visit India in the next month. Considering the overall facts and circumstances of the case, the petitioner is directed to appear before the trial Court and on doing so, he shall be released on interim bail on his furnishing adequate bail bonds/surety bonds to the satisfaction of trial Court. CRM-M-39918-2017 -2today, the instant petition shall be deemed to have been dismissed. It is, however, also clarified that this order shall not be an embargo in conducting the proceedings against the petitioner under Section 174A IPC by the trial Court.
