Virk, Advocate for the petitioner(s) SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Article 226/227 of the Constitution of India seeking issuance of appropriate writ, order or direction especially for issuance of a writ in the nature of Certiorari for quashing the impugned Terms and Conditions dated 05.08.2024 (Annex. P-3) to the extent of clauses 3 & 4 fixing remuneration even lesser than the minimum wages, being unfair, unjust, arbitrary, illegal, non-est and violating the fundamental rights of the petitioners.

Learned counsel for the petitioners submits that the issue involved in the present petition already stands adjudicated by this Court vide order dated 24.12.2025 passed in CWP-21074-2025 titled as 'Sudhir and others vs. State of Haryana and others'.

CWP-9923-2026 -2Mr. Deepak Balyan, Addl. AG. Haryana, having been served with an advance copy of petition, accepts notice on behalf of the respondent-State and undertakes that the State shall undertake a fresh consideration of the matter with regard to issue concerning entitlement of the petitioners to minimum wages by examining the case of each petitioner independently and shall pass appropriate orders in accordance with law and applicable legal provisions. In light of above, the impugned terms and conditions dated 05.08.2024 (Annexure P-3) is hereby quashed and the present writ petition is disposed of in terms of the order dated 24.12.2025 passed in Sudhir and ors. (supra), as the controversy involved herein is squarely covered by the said decision. Accordingly, the respondents are directed to extend the same benefits to the petitioners, as admissible under law, within a period of four weeks from the date of receipt of certified copy of this order. Ordered accordingly.
