*** HARSH BUNGER, J. (Oral) This is an application for impleading the legal representatives of appellant No.2 (Ganpat), who is stated to be expired on 12.03.2011. Notice in the application was issued on 09.02.2024. Upon notice, learned counsel for the non-applicant/respondents No.1 to 4 does not raise any objection if the prayer made in this application

-2is accepted.

Keeping in view the aforesaid submission made by learned counsel for the non-applicant/respondents No.1 to 4 as well as the reasons mentioned in the application, legal representatives of appellant No.2 are impleaded as legal representatives of appellant No.2 in the array of parties in RSA-4163-2001 only for pursuing this litigation. Amended Memo of Parties is taken on record, subject to all just exceptions.

Registry to carry out necessary changes.

This is an application for fixing an actual date of hearing in the main appeal (RSA-4163-2001).

Notice in the application was issued on 09.02.2024. Learned counsel appearing for the non-applicant/respondents No.1 to 4 submits that she has no objection, if the instant application is allowed and the main case is fixed for some actual date. In view of the above, the present application is allowed and the main appeal (RSA-4163-2001) is taken on board today itself. Through the instant application (CM-1146-C-2024), learned counsel for the applicant/appellants seeks permission of this Court to withdraw the main appeal i.e. RSA-4163-2001 as the parties are ad idem that the matter has been amicably resolved between them and therefore, they do not want to pursue the present appeal any further. For the reasons stated in the application (CM-1146-C-2024), the

-3same is allowed as prayed for and the main case (RSA-4163-2001), is dismissed as withdrawn.
