Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.195 dated 31.05.2016 under Sections 420, 466, 467, 468 and 471 IPC, registered at Police Station "A" Division Amritsar, District Amritsar City.

Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. As per the allegations in the FIR, the present petitioner has Vineet Gulati 2017.02.14 15:44 I attest to the accuracy and authenticity of this document Chandigarh taken amount of `1,25,000/- from the complainant for getting B.Ed.

CRM No.M-40802 of 2016 -2completed. Learned counsel for the petitioner states that some of the Universities have changed the policy, therefore, the Universities have cancelled the enrollment of some of the students. In the present case, challan has already been presented. The petitioner is in custody since 23.06.2016. He is not required for custodial interrogation or investigation as he is in judicial custody. The petitioner is simply to face trial. The trial of the case is at initial stage and will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.

Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with two sureties in the like amount to the satisfaction of the trial Court/Duty Magistrate.
