Petitioner No. 1 appears in person and submits that the present petition has been rendered infructuous, hence, the same may kindly be disposed of having been not pressed any further. 2.

Petitioner No. 1 further submits that during the pendency of the present writ petition, petitioner No. 2 had already left the service and had settled abroad and according to his information, petitioner No. 2 is also not interested in pursuing the present petition as of now. 3.

Keeping in view the statement made by petitioner No. 1 herein before and as petitioner No. 2 had already left the service and settled abroad, no further orders are required to be passed in the present petition, hence, the same is disposed of having been not pressed any further. 4.

However, liberty is granted to petitioner No. 2 that in case, he is still interested in pursing the present remedy, he can file an appropriate application for recalling the present order so as to decide the issue raised in

CWP-2970-2005 (O&M) the present petition qua petitioner No. 2 on merit. 5.

Pending civil miscellaneous application, if any, stands disposed of.
