The petitioner seeks the concession of pre-arrest bail in a case registered on the basis of a secret information that he had kept dry bhang. Recovery was not effected in presence of the petitioner. Pursuant to the interim order, the petitioner has joined the investigation. It will be debatable, during the course of trial, whether the petitioner could be said to be in actual physical possession of the above said contraband.

The petition is allowed and interim order dated21.11.2014 is hereby made absolute subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
