Seeking quashing of FIR, captioned above, and all consequential proceedings arising therefrom, the petitioners have come up before this Court by filing the present petition under Section 482 CrPC.

After arguing for some time, but facing stiff opposition from the State of Punjab, petitioner's counsel submits that he be permitted to withdraw the present petition with liberty to file application(s) for discharge on behalf of all those accused who want to file such application(s) by taking up the points which have been raised in this petition as well as additional points which they may come across and prayed for a direction to the trial Court to answer all such points while deciding the said application(s).

Given the nature of allegations and more particularly, the fact that in the complaint the allegations were only against 4-5 persons but now, more than 4-5 persons have been arraigned as accused, the petitioners are permitted to file separate application(s) for discharge and the trial Court is requested to consider every point raised in the application(s) and decide the same by passing a speaking and reasoned order, in case any such application is filed. In case the petitioner(s) are charged for any of the offences, they shall be at liberty either to challenge the same straightaway before this Court or before the Sessions Court, as per their discretion.
