IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CRM M-39988 of 2017 Date of decision : 26.04.2018 Sukhraj Mohammad @ Sona ....Petitioner V/s State of Punjab ....Respondent BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. P.K. Kataria, Advocate for the petitioner. Mr. A.A. Pathak, Addl. A.G. Punjab.
RAJAN GUPTA J.
This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 168 dated 14.04.2012 under sections 135 of Indian Electricity Act, 2003 at Police Station Anti Power Theft, Ludhiana. Admittedly, investigation has been completed and trial is in progress. Petitioner was granted interim bail vide order dated 06.12.2017. He is stated to have remained in custody for about four months before that Keeping in view the contentions made before this court and the fact that trial may still take some time to conclude, I am of the considered view that no useful purpose would be served by detaining the petitioner any longer. Accordingly, petition is allowed and petitioner is directed to be enlarged on bail to the satisfaction of Trial court/Duty Magistrate subject to such terms and condition(s) as it may deem fit to impose.
