(ORAL) In respect of prayer for setting aside the order dated 09.04.2019 (Annexure P-12), counsel for the petitioner states that he does not want to press the said prayer, at this stage. He seeks liberty to approach the respondents for the redressal of his grievance in respect of the fact finding enquiry, which is been held in respect of the complaint made by respondent No.5, at this stage.

As far as prayer of the petitioner for the release of the pensionary benefits for which he became entitled for after his retirement on 31.01.2019, counsel for the petitioner states that petitioner has already made an application/representation dated 05.04.2019 (Annexure P-11) to respondent No.2 for the release of the benefits for which he is entitled for after his retirement including the salary for the month of January, 2019. CWP-11353-2019 -2Counsel for the petitioner states that at this stage the petitioner will be satisfied in case a time bound direction is issued to respondent No.2 to pass an appropriate speaking order in respect of the relief as claimed by the petitioner in the said representation. Without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondent No.2 is directed to decide the representation dated 05.04.2019 (Annexure P-11) by passing a speaking order within a period of one month from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any relief as claimed in the said representation, the same shall also be released to him within a period of next one month. Present writ petition stands disposed of.
