*** RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.211 dated 28.05.2013, registered under Sections 451, 323 and 506 IPC, Police Station Zirakpur, District SAS Nagar (Mohali) (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise (P-2).
Pursuant to order dated 17.09.2018 of this Court, parties appeared before the trial Court on 26.10.2018 for recording their statements. Learned Judicial Magistrate Ist Class, Dera Bassi, has submitted her report vide letter bearing No.3 dated 03.01.2019 duly forwarded by learned District and Sessions Judge, SAS Nagar, vide Endst. No.108, dated 04.01.2019.
According to the report, ld. Judicial Magistrate Ist Class, Dera SONIKA 2019.04.03 17:44 I attest to the accuracy and authenticity of this document Chandigarh Bassi, is satisfied that the compromise is genuine, voluntary and without
CRM-M-40949 of 2018 --2-- any coercion and undue influence.
In compliance of order dated 07.03.2019, original receipts regarding deposit of costs of `15,000/- have also been produced in Court today. The same are taken on record. Be tagged at appropriate place. Considering the report of ld. Judicial Magistrate Ist Class, Dera Bassi, dated 03.01.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.211 dated 28.05.2013 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only.
Disposed of accordingly.
