The petitioner seeks the concession of regular bail in case registered on the allegation that on 18.4.2016, the police intercepted a motor cycle, on which petitioner along with two others was travelling. The petitioner allegedly escaped from the spot leaving two other co-accused behind, who were allegedly found in possession of 500 grams of heroin. So far as the petitioner is concerned,he was arrested on 29.4.2016 along with 30 grams of heroin. The culpability of the petitioner on 18.4.2016 will certainly be a debatable issue as he was not arrested along with the coaccused with the contraband. So far as the culpability pertaining to incident dated 19.4.2016 is concerned,30 grams of heroin recovered from the petitioner,is apparently a non commercial quantity.

Without expression of any opinion on merits of the case, the petitioner can be granted the concession of bail. The petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
