(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.295 dated 26.05.2016, registered at Police Station Palam Vihar, District Gurgaon, who has been booked for having committed an offence punishable under Section 10 of the POSCO Act.
Learned counsel for the petitioner submits that only allegation against the petitioner that he had done pedicure massage above the knees towards thigh of daughter of complainant and during that time she had not raised any hue and cry even after getting out of the saloon. The petitioner has been falsely implicated in the present case by levelling the grievous Naresh Kumar 2016.11.23 15:48 I attest to the accuracy and integrity of this document Chandigarh allegations. Moreover, nothing is to be recovered from the petitioner.
CRM-M-40892-2016 -2Learned State counsel on instructions from investigation officer, has informed that after presentation of the challan, the statement of eight witnesses is to be recorded.
I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 26.05.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Gurgaon.
