3. Whether the judgment should be reported in the Digest? AJAY TEWARI, J. (Oral) This is a petition for anticipatory bail filed in case bearing FIR No.134 dated 09.10.2015, under Sections 326, 325, 323, 324, 341, 506, 148, 149 IPC, registered at Police Station Kharar.
On the last date the following contention was noticed:- "Learned counsel has argued that the injury attributed to the petitioner is not consisted with the medico legal report and in fact the petitioner himself received nine injuries and a cross-case has also been registered against the complainant."
Learned counsel for the petitioner has further pointed out that two persons from the petitioner's side have been arrested and released on regular bail. Learned counsel for the complainant SUNITA NAGPAL 2015.12.07 10:20 I attest to the accuracy and authenticity y of this document Chandigarh
and learned Addl.AG, however, point out that the petitioner's side had inflicted in all 26 injuries and suffered 12 injuries. Learned counsel for the complainant has further argued that the grievous injury is attributed to the petitioner. Learned counsel for the petitioner has countered by arguing that the grievous injury is a cut on the little finger.
Keeping in view all the facts I do not deem it appropriate to decline the concession of anticipatory bail to the present petitioner. Let him appear before the investigating officer on 14.12.2015 between 10.00 a.m. to 5.00 p.m. and on any other date on which his appearance is so required by the investigating officer. On his appearance the investigating officer shall release him on anticipatory bail to his satisfaction subject to the conditions as envisaged under Section 438(2) Cr.P.C.
Petition stands disposed of.
