The petitioner is seeking anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (erstwhile Section 438 Cr.P.C.) in FIR No. 33 dated 11.02.2026, under Sections 105, 115(2) & 3(5) of BNS, 2023 (erstwhile Sections 304, 323 & 34 IPC), registered at Police Station Sadiq, District Faridkot.

The case of the prosecution is that complainant Boota Singh got his statement recorded stating that he had gone to the house of Reshma Kaur at her request. When he entered her house, some one attacked him with 'tamba'. Amar Singh and his brother along with two brothers of Reshma Kaur tied him and caused him multiple injuries with rod and stick of 'toot' tree. His family members and people, saved him. He was admitted to Guru Gobind Singh Medical College and Hospital, Faridkot. He further stated that if he died during treatment, then said persons will be responsible. Thereafter during treatment Boota Singh died.

Per contra, learned State counsel and counsel for the complainant have opposed the prayer for grant of bail to the petitioner on the ground of gravity of allegations. Learned State counsel has filed the status report by way of affidavit of Tarlochan Singh, Superintendent of Police, Sub Division Jaitu, District Faridkot and the same is taken on record. 5.

I have heard the learned counsel for the parties and perused the record.

Keeping in view the entire facts and circumstances of the case and the fact that 14 injuries were inflicted upon the deceased and the statement of the deceased found full corroboration from the disclosure statement of co-accused Amar Singh; the allegations against the petitioner are serious and grave in nature; the investigation is at nascent stage; accordingly, the custodial interrogation of the petitioner is necessary for thorough and effective investigation of the case. Therefore, considering the seriousness and gravity of the allegations, no exceptional or extraordinary grounds are made out for grant of anticipatory bail to the petitioner. 7.
