Through the instant petition, the petitioner is seeking anticipatory bail in case FIR No.1052 dated 13.08.2015, registered under Sections 4981A, 323, 406 and 34 IPC (subsequently added Section 377 IPC) at Police Station Gurgaon City, District Gurgaon. Learned counsel for the petitioner states that pursuant to order dated 28.11.2015, passed by this Court, the petitioner has joined the investigation and has cooperated. He further states that the matter was settled before the mediators and they were to pay 8,00,000/1, out of which 3,00,000/1 has been paid and divorce petition has been filed and second motion is fixed for April, 2016. Learned State counsel on instructions has stated that the petitioner has joined the investigation.

Looking to all these circumstances, but without commenting on the merits of the case, the petition is allowed and order dated 28.11.2015 granting interim bail to the petitioner is made absolute subject to the conditions laid down in Section 438 Sub Section 2 Clauses (i)(ii) and (iii) of the Code of Criminal Procedure.
