******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 186 dated 20.07.2015 registered for offences punishable under Sections 420 and 406 of Indian Penal Code (for short 'IPC'), at Police Station Patran, District Patiala.

Heard.

As per case of complainant, he was married with petitioner no. 1-Vikramjit Kaur. In order to settle complainant-respondent no. 2 and petitioner no. 1-Vikramjit Kaur abroad, a payment of `21 lacs was made to petitioners on asking of a travel agent but neither complainant-respondent no. 2 was sent abroad nor the money was returned. It is submitted that the matter is still under investigation and petitioners have surrendered before the police and joined the investigation. CRM-M-40075 of 2015 -2payment was made and how it was paid. The entire version of petitioners regarding payment of `21 lacs is based on oral testimony, veracity of which is to be decided during trial.

Without expressing any opinion on the merits of the case, this petition is allowed and order dated 28.11.2015 is made absolute till the presentation of challan, subject to the following terms:- (i) that petitioners shall make themselves available for interrogation by the police as and when required; (ii) that petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against them so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that petitioners shall not leave India without the prior permission of the Court.

(iv) that petitioners will seek regular bail on the presentation of challan in Court.
