(Oral) Prayer in this petition is for setting aside order dated 06.01.2014 passed by learned Judicial Magistrate Ist Class, Ludhiana whereby the interim custody of the vehicle alto car has been handed over to respondent No. 2 and order dated 20.09.2014 whereby appeal against the above said order has been dismissed.

A perusal of impugned order shows that the sister of respondent No. 2 solemnized marriage with the petitioner and the alto car was given by father of respondent No. 2 on the demand of the accused. The marriage was solemnized on 08.07.2010 and car was booked on 27.07.2010 and the delivery was taken on 02.08.2010 and the car was purchased in the name of Pankaj Rana but the payment was made by father of respondent No. 2. The application for releasing the car on superdari was filed by respondent No. 2 which was rightly allowed as the gate pass of alto car as well as order of booking form of the said car was produced by respondent No. 2. The payment of the said car has also been made by father of respondent No. 2. Further the car is booked in

Crl. Misc No. M-40187 of 2014 Ambala and was purchased from Eakansh Wheels Authorised Maruti Suzuki Delers, KM Stone 126, Village Tepla State Highway No. 5, Jagadhari Road, Ambala Cant and if the car has been purchased by the petitioner, he would have purchased the car from Ludhiana, where he resides permanently. Both the Courts below have rightly appreciated the facts led by the parties and thus, no ground is made out to interfere in the orders dated 06.01.2014 and 20.09.2014.

Accordingly, the petition stands dismissed.
