The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of interim bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of Petitioner(s) FIR No.

After hearing the submissions addressed by counsel for the petitioner, on 02.04.2026, following order was passed:-

Learned counsel for the petitioner contends that wife of petitioner is a patient of stone in gallbladder and surgery has been advised by the surgeon. In support of the contention, medical documents (Annexure P-2) have also been appended.

On advance notice, Mr. Neeraj Madaan, Senior DAG, Punjab, puts in appearance on behalf of the respondent - State, and prays for some time to verify the factual position including the medical condition of the patient and details of other family members, who possibly could look after the procedure required for the surgery of the ailment of the petitioner's wife. 5.

List on 07.04.2026."

Today, learned State counsel has filed status report dated 19.04.2026 in the Court today and the same is taken on record. Registry is directed to tag the same at the appropriate place on the file. 4.

As per the details mentioned in paragraph Nos.11 and 12 of the status report, it is evident that Mandeep Kaur (wife of the petitioner) has been diagnosed with a gall bladder stone measuring 6.5 mm. Further, as per the medical opinion dated 16.04.2026, she is suffering from chronic cholelithiasis (gallstones) and has been advised to undergo surgical intervention, namely laparoscopic cholecystectomy, at the earliest. The said surgery is urgently required, and she would need proper pre-operative as well as post-operative care from a close family member or attendant.

Additionally, statement of the Sarpanch of Village Tibbi Khurd, namely Surinder Kaur, has been recorded, wherein it has been clarified that there is no other adult member in the petitioner's household, and the children are aged only 15 and 13 years.

This Court has heard the submissions advanced by counsel for the parties and has also perused the status report placed on record. 7.

Considering the contents of the status report filed by the State, this Court deems it appropriate to grant the concession of interim regular bail to the petitioner in the present case. Accordingly, present petition is allowed.

Accordingly, petitioner is ordered to be released on interim bail uptill 22.05.2026, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 9.
