Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.127 dated 10.08.2016 under Sections 364, 302, 148, 149, 473, 120-B IPC and Section 25 of the Arms Act, registered at Police Station Sadar, Tarn Taran. Notice of motion.

Ms.Monika Jalota, DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per the allegations in the FIR, Dilbagh Singh, husband of the complainant was taken from the house and was murdered. The present petitioner is nominated in the FIR. CRM No.M-41107 of 2018 -2that it is a case of gang-war and active role has been attributed to the petitioner. He also stated that 11 FIRs are already registered against the present petitioner.

Keeping in view the facts and circumstances of the present case and in view of the fact that case is at preliminary stage, as even charges have not been framed, I do not find it a fit case where petitioner is entitled to benefit of regular bail.

Therefore, finding no merit in the present petition, the same is dismissed.

It has been brought to the notice of this Court that challan against the petitioner had been presented in the year 2015 and against other accused in 2016 but still charges have not been framed. Learned trial Court is directed to proceed with the case expeditiously, as per law.
