During the course of hearing of the instant matter, learned counsel for the petitioner has not disputed the fact that the petitioner is involved in case bearing FIR No.378 dated 12.11.2020, registered under Sections 379-B, 411, 465, 467, 468, 471 & 120-B of the Indian Penal Code and Section 25 of the Arms Act, at Police Station Sohana, District S.A.S. Nagar (Mohali). It is further stated that the case is now pending trial before the trial Court.

Learned counsel for the respondents submits that since FIR No.378 dated 12.11.2020 is pending trial against the petitioner before the trial Court; accordingly, he is required to submit an order from the concerned Court, permitting him to depart from India, in terms of the Government Instructions issued vide G.S.R. 570(E) dated 25.08.1993. 4.

Faced with this situation, learned counsel for the petitioner submits that he may be permitted to withdraw the instant writ petition with liberty to the petitioner to approach the concerned Court where the trial is pending against him in FIR No.378 dated 12.11.2020, so as to seek permission to depart from India in terms of the Government Instructions issued vide G.S.R. 570(E) dated 25.08.1993; and thereafter, to apply afresh for issuance of his passport.
