Allegations against the petitioner/accused are that 620 intoxicating tablets were recovered from his possession on 5.7.2015 when he was intercepted by the police.
It is contended that a false case has been foisted upon the petitioner and even the alleged recovery is of non-commercial nature. The petitioner is in custody since 5.7.2015 and investigations qua him are over since challan has been presented. It is further submitted that there is no other case registered against him. CRM-M 40140/2015 Singh does not refute the nature of quantity, period of custody, no other case pending against the petitioner; and that challan has been presented. Without expressing anything on the merits of the case, keeping in view the fact that the challan has been presented and the trial is not likely to be concluded in near future and no useful purpose would be served by keeping the petitioner in custody, the present petition is allowed and petitioner is directed to be released on bail subject to the satisfaction of CJM/Duty Magistrate concerned. 08.12.2015.
