Vide order dated 15.01.2014, the petitioner was allowed bail with the condition that after receipt of FSL report, the prosecution will be at liberty to move application seeking cancellation of bail in case the quantity of contraband recovered from him is found to be commercial.

The prosecution moved application seeking cancellation of bail of petitioner on 02.09.2014 of which notice was issued to the petitioner, who had gone absent on 20.10.2014. It is submitted that the petitioner was arrested on 21.09.2015 and is now in judicial custody.

It is admitted that application moved by the prosecution on 02.09.2014 is still pending before the trial Court. This petition is disposed of with liberty to the petitioner to move fresh application for bail before the trial Court. While deciding that application, the trial Court will dispose of application dated 02.09.2014 filed by the prosecution.
