**** ANITA CHAUDHRY, J (ORAL) This petition has been filed by the petitioner under Section 482 Cr.P.C. for quashing the order dated 16.3.2017 passed by the Judicial Magistrate, Ist Class, Faridabad in a complaint filed under the Domestic Violence Act.
I have heard the counsel for the petitioner at length. The petitioner is aggrieved as the trial Magistrate has allowed interim maintenance of Rs. 5,000/- to the wife. The trial Court had noted the salaries of both the parties and had taken into account that the wife was earning Rs. 26,000/- per month and she was working with M/s Accenture Services Private Limited and that the husband was earning over Rs. 73,000/- per month and it had allowed Rs. 5,000/- per month as interim maintenance. Aggrieved by the order, an appeal was preferred by the husband which has been dismissed.

Crl. Misc. No. M-40204 of 2017 -2and maintain as if she continues to stay with the husband. She is entitled to the same status and facilities. The husband is earning over Rs. 73,000/- per month. The wife is getting salary of Rs. 26,000/- per month. I find no infirmity in the order passed by the trial Court. The petition is dismissed.
