Present petition under Section 482 Cr.P.C. for quashing of order dated 01.04.2019 (Annexure P3), passed by the learned Judicial Magistrate Ist Class, Chandigarh.

Petitioner was declared proclaimed person in proceedings arising under Section 138 of the Negotiable Instruments Act, 1881. Learned counsel for the petitioner contended that most the complaints have been withdrawn as cheque amount has been paid. Learned counsel further contended that even in the case of present complaint, payment more than the cheque amount has bee paid. However, since the petitioner was declared proclaimed person, therefore, the complaint was not withdrawn. In view of the submissions made by learned counsel for the petitioner, present petition stands disposed of with the directions to the petitioner to surrender before the learned trial Court on 24.05.2019 and shall file an application for granting regular bail to him.
