RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to pandemic Covid-19.

Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to petitioner - Rani - in case FIR No.71 dated 23.06.2020 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Subhanpur, District Kapurthala.

According to prosecution, on 23.06.2020 on the basis of secret information, Activa driven by petitioner coming from the side of Hamira on a kacha passage was intercepted by police. On seeing police party, petitioner throwing the contraband, which on weighing came to 252 grams, succeeded in fleeing away.

Learned State counsel contends that petitioner was found involved in five more cases of similar offence earlier to the present FIR. She is habitual offender and trader of contraband. She is required for custodial interrogation.

Considering overall facts and circumstances, this Court is not inclined to grant concession of anticipatory bail to the petitioner, inasmuch as she is very much required for custodial interrogation. Dismissed.
