Through this petition under Section 439 Cr.P.C., petitionerRajender, has prayed for grant of regular bail in case FIR No. 608 dated 26.09.2017 registered under Sections 120-B, 148, 149 and 302 IPC and Section 25 of the Arms Act at Police Station City, Bahadurgarh. 2.
According to the prosecution, son of the petitioner, namely; Sunil @ Lala, demanded a ransom of ` 36 lakhs from the real brother, namely; Monu Joon of complainant-Ankit, extending threat to his life. Therefore, Monu Joon, aforesaid got lodged an FIR against Sunil @ Lala and his companions in police station, Bahadurgarh. Thereafter, around 7.00 A.M. on 26.09.2017, Monu Joon was murdered by co-accused Sunil @ Lala son of the petitioner by firing shots upon him along with his companions who also took active participation in the murder of Monu Joon by firing upon him.

CRM-M-40232-2017 -2allegation levelled by the complainant against the petitioner is that he being father of main accused, namely; Sunil @ Lala had conspired to the murder of Monu Joon. The petitioner was not present at the time of murder of Monu Joon. He has been falsely implicated.

On the other hand, learned State counsel vehemently opposed the bail to the petitioner.

Considering the overall facts and circumstances of the case, but without expressing any opinion on the merits and also that conclusion of the trial may take time, the instant petition is allowed. Petitioner-Rajender, is ordered to be released on bail pending trial, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Jhajjar.
