Main Case.
Prayer is for grant of anticipatory bail on behalf of Gurmej Singh, his wife, son and another co-accused Baljinder Singh in FIR No.64 dated 12.10.2015 under Sections 295-A,452,447, 427, 148,149 IPC, PS Sekhwan,Police District Batala, District Gurdaspur. As per allegations four accused armed with datar and dangs forcibly trespassed into the Church and demolished the wall of the Church.
It is contended that at the site there is no construction much less a Church. In fact, there is agriculture land of which the petitioners RAJINDER PRASHAD JOSHI 2015.12.17 17:44 I attest to the accuracy and authenticity of this document High Court, Chandigarh.
CRM-M 40178/2015(O&M) are co-owners and the dispute is regarding partition of the land. Learned counsel for the petitioners submits that pursuant to the interim order passed by this Court, petitioners have joined the investigation.
Learned State counsel assisted by SI Sardool Singh concedes that petitioners have joined investigation and are no longer required for custodial interrogation.
In view of the above, interim protection/pre-arrest bail granted vide order dated 30.11.2015 is made absolute. Petition stands disposed of.
