Application is allowed.

Reply on behalf of respondents No.4 to 7 is taken on record. CRM-M-21132-2024 Petitioner is seeking issuance of directions to respondents No.2 and 3 to expedite the investigation and present challan against the private respondents No.4 to 8 in FIR No.167 dated 11.05.2018 under Sections 323, 341, 506, 148, 149 of the IPC and Sections 3 and 4 of the SC/ST Act.

While issuing notice of motion, it had been urged by the learned counsel appearing for the petitioner that the investigating agency PUNEET SACHDEVA 2024.09.10 16:17 I attest to the accuracy and integrity of this document Chandigarh

CRM-35836-2024 in/and CRM-M-21132-2024 had not been carrying out proper investigation in the case in hand and had not presented the challan.

On being put to notice, learned State counsel has, on instructions, drawn the attention of this Court to the reply dated 11.05.2024 filed by way of affidavit of D.S.P., Dakha, District Ludhiana, and submitted that a thorough investigation was carried out into the allegations levelled in the FIR in question, however, not once but twice, no grain of truth was found in the allegations levelled, as a result of which cancellation had been recommended in the present FIR.

In the circumstances, no ground is made out for issuance of directions, as prayed for.

Dismissed.

However, the petitioner is at liberty to avail of alternate remedies under law.
