***** Rajan Gupta, J. (Oral) Petitioner, in this petition, has invoked the jurisdiction of this court under Section 438 Cr.P.C. as his bail bonds have been cancelled. It has been urged before the court that the petitioner had to move an application for exemption from appearance as he was suffering from stomach ailment. According to the State counsel, trial is being delayed on account of repeated adjournments being sought by the petitioner. Trial court has cancelled the bail as it felt that concession of bail was being misused by the petitioner.

However, keeping in view the facts and circumstances of the case, it is directed that in case the petitioner surrenders before the trial court within a week from today, he shall be admitted to bail subject to stringent conditions.
