The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to release the balance amount of enhanced gratuity as per the Payment of Gratuity (Amendment) Act, 2018 in view of the letter No.404387 dated 04.08.2022 (Annexure P-4) and for which several representations including the legal notice dated 05.12.2025 (Annexure P-6) has also been served by the petitioners. Further, for directing the respondents to release the amount of enhanced gratuity as per the Payment of Gratuity (Amendment) Act, 2018.

Learned counsel for the petitioners submits that he would be satisfied if the legal notice (Annexure P-6) of the petitioners is decided by respondents No.1 & 2 by passing a speaking order in a time bound manner. 3.

Learned State counsel, appearing on advanced notice, submits that he has no objection in case a direction is issued to respondents No.1 & 2 for NEHA 2026.04.10 13:43 I attest to the accuracy and integrity of this document Punjab and Haryana High Court, Chandigarh

Therefore, in view of the limited prayer made by learned counsel for the petitioners, respondents No.1 & 2 are directed to consider the legal notice (Annexure P-6) of the petitioners and pass a speaking order, after affording them an opportunity to be heard, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by respondents No.1 & 2.
