**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.369 dated 12.11.2016, under Sections 363 and 366 IPC (the offence punishable under Section 376 IPC was added later on), registered at Police Station Zirakpur, District Mohali.
Perusal of the allegations shows that daughter of the complainant was taken by the petitioner to his house at Zirakpur and thereafter he has threatened her.
Learned counsel for the petitioner has placed on record the photographs (Annexure P-1) to show that the complainant's daughter has solemnized the marriage with the petitioner as she was major. Naresh Kumar 2017.01.19 10:35 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-403-2017 -2Learned State counsel states that the contents of letter (Annexure P-3), which was supposed to be written by daughter of the complainant for cancellation of present FIR, are still to be verified. I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 19.11.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Mohali.
Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
