Prayer in all the above captioned petition(s) is for grant of bail to the petitioners, Satish Kumar, Harjap Singh, Navdeep Singh and Gurwinder Singh, who have been booked for having committed the offences punishable under Sections SEEMA RANI 2015.03.03 16:27 I attest to the accuracy and authenticity of this document Chandigarh
120-B and 384, IPC, and Sections 7 and 8 of the Prevention of Corruption Act, 1988, in a case arising out of FIR No.74, dated 25.07.2014, registered at Police Station, Lambra, Jalandhar. Learned counsel for the petitioner(s) submits that all the material witnesses, namely, Harjinder Singh (PW1), Harwinder Singh (PW2), Narinder Singh (PW3) and Rupinder Singh (PW4) have been examined and they have failed to support the prosecution case. The examination of the remaining prosecution witnesses would not improve the case of the prosecution. He prays for withdrawal of the present petition to enable the petitioner(s) to file fresh applications before learned trial court in view of the changed circumstances. Learned counsel for the State has no objection to the above prayer made by learned counsel for the petitioner(s).
As such, the above petitions are disposed of with a direction that if the petitioner (s) move application (s) for grant of regular bail those shall be decided without being influenced with the previous orders of dismissal and taking into consideration the changed circumstances, within three working days of its filing.
