This petition has been filed under Section 528 BNSS (erstwhile Section 482 Cr.P.C) for quashing of impugned order dated 05.11.2024 passed by ld. JMIC, Sri Anandpur Sahib whereby the petitioner has been declared proclaimed offender in NACT No. 71 of 2020 and to allow the petitioner to join the proceedings before the ld. JMIC.

Learned counsel for the petitioner submits that the petitioner could not appear before the ld. Courts below as he was bed ridden and was being looked after by his old aged mother. As such the learned trial Court vide order dated 05.11.2024, the petitioner was declared as proclaimed person. He further prays that the petitioner is ready and willing to join the proceedings before the Court and the impugned order declaring the petitioner proclaimed person be set aside.

I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the learned counsel for the petitioner, this Court deems it appropriate to decide this case without issuing notice to respondent and does not find any legitimate ground to interfere in the impugned order dated 05.11.2024 passed by ld. JMIC, Sri Anandpur Sahib. However, in case the petitioner surrenders before the trial Court within a period of 10 days from today at 10:00 A.M and moves an application for grant of regular bail, the trial Court is directed to consider and decide the same on the very same day.
