******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure (for short Cr.P.C.) for grant of anticipatory bail to the petitioner in case FIR No. 78 dated 06.04.2016 registered for the offences punishable under Sections 302, 307, 148 read with Section 149 of Indian Penal Code, 25, 27 of Arms Act at Police Station City Jagraon, Ludhiana. Heard.

Learned State counsel on instructions from ASI Baljinder Kumar submits that during the police enquiry, petitioner was found innocent and the supplementary challan has already been presented before the trial Court to this effect. Petitioner has been summoned by the trial Court on the application of the prosecution under Section 319 Cr.P.C. CRM-M-40358-2017 -2interrogation of petitioner is no more required, this petition is allowed and the order dated 30.10.2017 is made absolute subject to the condition that petitioner shall apply for regular bail (if not applied and allowed so far) before the trial Court and will keep on appearing on each and every date of hearing. In the event of his non-appearance on any date without permission, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and proceed against him in accordance with law.
