Petitioner seeks concession of regular bail in a case registered against him under sections 323, 332, 353, 307, 224, 225, 120-B, 34 IPC & section 25, 54, 59 of the Arms Act vide FIR No. 0231 dated 17.06.2017 at police station Sector 5, Panchkula. It has been urged before the court that no role has been attributed to petitioner in the commission of crime. He has been arraigned as an accused on the basis of disclosure statement made by co-accused Joginder @ Joga. Thus, he is entitled to bail. Plea has been opposed by learned State counsel on the ground that offence is serious in nature. In case enlarged on bail, petitioner is likely to intimidate the witnesses.
An incident occurred on 17.06.2017. Complainant ASI Tara Chand alongwith other police officials had taken one Deepak, an accused in another case, to hospital in Sector 6, Panchkula. As they were coming out of room in the hospital, associates of accused-Deepak threw some poisonous substance in the eyes of police and fled. CRM M-40367 of 2017 shots on the police party. During the course of investigation, accused Joginder @ Joga was arrested. He suffered a disclosure statement as regards involvement of petitioner in the case. At his instance, two mobiles phones were recovered which was used in the commission of crime. Trial court has rejected the plea for bail with the observation that the petitioner appeared to be a notorious gangster. This court does not intend to express any opinion on the merits of the case.
