**** RITU BAHRI , J. (Oral) The present petiton is against order dated 15.09.2016 passed by learned Addl. Sessions Judge, Kapurthala (P-3) whereby the application filed by the petitioner under Section 311 Cr.P.C was dismissed.
A perusal of order dated 15.09.2016 shows that this application has been made after change of counsel and all the three witnesses i.e Sukhjit Kaur, Jupinder Singh and SI Ranjit Singh, SHO were thoroughly examined after giving full opportunity to the defence counsel.
It is not the case of the accused that the above three witnesses were never represented before the trial Court.
Crl. Misc. No. M-41231 of 2016 Learned counsel states that the important question is with regard to involvement of bus but this argument is liable to be rejected as this fact was in the knowledge of the learned counsel appearing for the accused/petitioner right from the beginning. No ground is made out to interfere in order dated 15.09.2016.
Dismissed.
