***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.322 dated 21.04.2017 under Section 379 IPC and Sections 25, 54, 59 of Arms Act, registered at Police Station Model Town, Panipat.

Learned counsel for the petitioner submits that petitioner is incarcerated since 04.07.2017. Independent witness has not supported the prosecution version. Only official witnesses remain to be examined. Other similarly placed accused has been granted bail. Learned State counsel has opposed the prayer for bail. Heard.

Keeping in view period of his incarceration and the fact that trial may still take some time to conclude, no useful purpose would be served by detaining the petitioner during pendency of the trial, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and the petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Panipat.
