The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

FIR No. 92 dated 07.11.1992, under Sections 22/61/85 of the NDPS Act read with Sections 489, 411, 414 of IPC and Sections 25/54/59 of the Arms Act, was registered against the petitioner at Police Station, Srai Amanat Khan, District Tarn Taran. In the said FIR, police after completing investigation has filed cancellation report. The petitioner applied for issuance of passport on 09.04.2022, however, till date passport has not been issued to him.

Notice of motion.

Mr. Hemant Hans, Central Government Counsel for Union of India and Mr. Aman Dhir, DAG, Punjab, who on advance notice are present in Court, accept notice and waive service.

Mr. Aman Dhir, DAG, Punjab submits that petitioner is involved in another FIR bearing No. 104 dated 17.07.2014, under Sections 411 of IPC, 21/61/85 of NDPS Act and 14 F Act, registered at Police Station Gharinda, District Amritsar. The police after completing investigation has already filed its report and charges stand framed. 6.

On being confronted with Notification No. 570 dated 25.08.1993 issued by the Central Government, the petitioner seeks permission to withdraw the instant petition with liberty to approach trial court.

Dismissed as withdrawn with liberty to petitioner to approach trial court. This Court is sanguine of the fact that trial court would decide application of the petitioner in terms of Notification No. 570 dated 25.08.1993 issued by the Central Government.
