The petitioner not having been called for interview for the post of Forester, which were advertised in the year 2015, had approached this Court seeking a direction to be issued to enable the petitioner to participate in the interview provisionally.

This Court, while issuing notice of motion on 30.4.2019, had directed that the petitioner be interviewed provisionally and that the result be kept in a sealed cover. Accordingly, the petitioner was interviewed. 3.

Today, the learned State counsel has submitted the result of petitioner in a sealed cover, which has been opened. It has otherwise been informed by learned State counsel that the result of all other candidates other than the PANKAJ KAKKAR 2020.10.08 19:24 I attest to the accuracy and integrity of this document

( 2 ) CWP-11167-2019 (O&M) candidates in respect of whom there were some special directions, has since been declared.

The sealed envelope has been opened, which contains the result sheet in respect of the petitioner Ashish, as per which the petitioner has secured 136 marks out of 200 in the written test and 15 marks in Viva-Voce out of 25 marks thus making a total of 151 marks.

The learned State counsel has informed that the last selected candidate, as per the result declared, had secured 159 marks in the 'General Category'. 6.

Faced with the aforestated position, the learned counsel for the petitioner submits that, he may be permitted to withdraw the present petition with liberty to challenge the correctness of the marks awarded to the petitioner. 7.

In view of the aforestated position, the present petition is dismissed as withdrawn with liberty aforesaid.
