The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.187 dated 1.10.2017 registered for the offences under Sections 420 and 406 IPC at Police Station Sultanwind, District Amritsar City.

Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and Mr. Veneet Sharma, learned Advocate has appeared for the complainant and contested this petition.

I have heard learned counsel for the parties as well as learned State counsel appearing for the respondent-State and have gone through the record.

Cr. Misc. No.M-40437 of 2017 [2] At the time of arguments, learned counsel for the petitioner argued that the parties have already effected compromise. Learned counsel for the complainant stated that some terms of the compromise are still to be complied with in future, therefore, the petitioner be asked to remain bound by the terms of the compromise. Learned counsel for the petitioner stated that the petitioner will remain bound by the terms of the compromise. Keeping in view the above facts and the fact that the petitioner has already joined the investigation, no useful purpose will be served by sending the petitioner to custody. Therefore, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 2.11.2017 passed by this Court granting interim bail to the petitioner is made absolute.

However, the petitioner shall remain bound by the terms of the compromise.
