******* SURINDER GUPTA, J.(Oral) This is third petition filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 458 dated 11.11.2016 registered for the offences punishable under Sections 420, 467, 468, 471 of Indian Penal Code at Police Station Rai, District Sonepat.
Heard.
As per the allegations of prosecution, property of Surat Singh, who died on 31.10.2012 was sold by an impersonator vide sale deed dated 26.10.2016 and the petitioner had identified that impersonator at the time of execution of sale deed. In view of the above facts, the petitioner is an important link to disclose the name of the person whom he had identified. CRM-M-40455-2017 -2identified executant of the sale deed, who impersonated as Surat Singh on the basis of his identity proof i.e. Aadhar Card. Even if the contention raised by learned counsel for the petitioner is believed, still he has identified a person who used Aadhar Card of Surat Singh. If the petitioner is allowed bail and his custodial interrogation is missed, the entire link evidence in this case will get missed and prosecution will not be in a position to reach the real culprit. Keeping in view the above facts, learned trial Court has rightly declined the benefit of anticipatory bail to the petitioner. I find no reason to interfere in the order passed by the trial Court. Dismissed.
