While assailing the correctness of the impugned order passed by the Motor Accident Claims Tribunal, Hisar (hereinafter referred to as 'the Tribunal') dismissing an application of the registered owner to examine its representative in evidence, the present revision petition has been filed. The owner wants to appear in evidence and prove that when they employed the driver, i.e. respondent no.1, a proper driving test was taken and his driving licence was also checked, which appears to be genuine. The Tribunal has taken a very narrow view of the matter. While deciding the claim petitions, the Court is required to take a holistic view. No doubt, these claim petitions are required to be decided expeditiously, however, the same cannot be done at the cost of justice. Keeping in view the aforesaid facts, the revision petition is allowed. One opportunity is granted to the petitioner to produce its entire evidence on the date to be fixed by the Tribunal, within one month, from today.
