Mr. S.P.S Sidhu, Advocate for the complainant. AJAY TEWARI, J (ORAL) Prayer is for grant of pre-arrest bail in case FIR No.125 dated 31.07.2015 under Sections 498-A/406/506 IPC, P.S Dharamkot, District Moga.

Parties are present in person. Petitioner states that he is very keen to rehabilitate this marriage and wants to resume cohabitation with the complainant. On the last date also, the matter was adjourned for this purpose. The complainant, however, states that at this stage, she is not in a position to accept any proposal for rehabilitation. In order to test the bonafide of the petitioner, when the petitioner was asked by this Court whether he was willing to pay some amount as maintenance to the complainant because admittedly the couple has been staying separately for the last about two years, he states that he

CRM-M- 40413 of 2015 #2 is ready to pay a sum of Rupees two and half lacs as interim maintenance to the complainant-wife in a period of two months subject to any order which may be passed by any competent court in this regard. to make the said payment.

Learned counsel for the complainant and learned Addl.A.G have accepted this statement.

It is directed that in case the petitioner pays an amount of Rs.2.5 lacs to the complainant on or before 18.2.2016, the Investigating Officer shall confirm his bail.

In case, this amount is not paid, this petition shall be deemed to have been dismissed.
